David Patterson Jr., the ex-partner of Matt Barnes’ current fiancee, is suing the former NBA champion, alleging that Barnes caused him injury, emotional distress, and more during the incident that occurred at a 49ers game last weekend. Patterson Jr. filed the lawsuit in L.A. County Superior Court on Friday, as obtained by TMZ Sports.
In the suit, Patterson Jr. claims that he had no prior knowledge that Barnes would be present at the 49ers vs. Cowboys playoff game in Santa Clara on Sunday. However, when the two happened to encounter each other in a concourse at Levi’s Stadium, they reportedly began yelling at each other from about 20 feet away.
Patterson Jr. claims in the lawsuit that Matt Barnes approached him unprovoked and spat directly in his face, which was captured by multiple cell phone cameras, at the 49ers game last Sunday. He is suing Barnes for battery, assault, and intentional infliction of emotional distress, and is seeking unspecified damages.
In a video posted on Twitter which you can see below, it’s pretty clear Matt Barnes DID IN FACT SPIT on someone!

Additionally, Patterson Jr. stated in the court documents that this incident was not the first time he had run-ins with Barnes, who he alleges has harassed and threatened him repeatedly in the past.
Patterson Jr. claims that he has text messages that show Matt Barnes called him derogatory names and threatened him in the past. He also alleges that Barnes told him “Pull up & get your ass whooped in front of your kids. I’m done talking.”
Barnes, on the other hand, has stated in an application for a temporary restraining order that Patterson Jr. has been the one who has been harassing and threatening him over the past few months and that Patterson Jr. was the aggressor in the altercation at Levi’s Stadium. Barnes was granted the temporary restraining order and both parties are expected to meet in court for a hearing on February 16th.
